قیامِ پاکستان کے بعد طویل عرصے تک ملک میں 1872 کا برطانوی "ایویڈینس ایکٹ" (Evidence Act 1872) نافذ رہا۔ اکتوبر 1984 میں اس وقت کے صدر جنرل ضیاء الحق نے اس قانون کو اسلامی اصولوں کے سانچے میں ڈھالنے کے لیے "قانونِ شہادت آرڈر" کے نام سے نافذ کیا۔ اس قانون کا بنیادی مقصد عدالتی نظام میں گواہی اور ثبوت کے معیار کو قرآن و سنت کے احکامات کے مطابق بنانا تھا۔

یہ قانون پاکستان کی تمام دیوانی (Civil) اور فوجداری (Criminal) عدالتوں پر لاگو ہوتا ہے۔ یہ عدالت کو یہ فیصلہ کرنے میں مدد دیتا ہے کہ کون سا ثبوت قابلِ قبول ہے اور کون سا نہیں۔
